MIGRASH ONLINE Legal Center
Version 5.2 — last updated 27 September 2026
MIGRASH ONLINE is currently operated by Oleg Yampolsky as an individual operator. The project is not yet registered as a company; incorporation is planned. The current contact address for all legal, privacy, IP and accessibility notices is migrashonline@gmail.com, and the Support page is available at /help.
The Platform is currently free to use. Paid listings, dealer subscriptions, Boost, Premium, Top and other checkout-based services are planned but are not currently active — see Section 13.
1. Terms of Use
1.1. MIGRASH ONLINE ("MIGRASH", "the Platform", "the Site") is a digital platform for publishing, discovering, viewing and discussing offers for vehicles and, in designated sections, vehicle parts, accessories, tuning products and related goods, together with communication and community features.
1.2. MIGRASH provides digital infrastructure and does not become the seller, buyer, owner, agent, broker, appraiser, inspector, repairer or guarantor of a vehicle or part solely because it is displayed on the Platform.
1.3. The sale contract or other transaction is concluded directly between the relevant users. MIGRASH is not a party to that transaction unless a separate MIGRASH service expressly states otherwise.
1.4. Use of the Platform requires compliance with Israeli law and any other law that applies to the user’s conduct.
1.5. Account information must be accurate and kept current. The Platform may require verification steps for safety, fraud prevention or business-seller status.
1.6. Users must be at least 18 years old to create an account, publish listings, message other users or enter into transactions arranged through the Platform. Age is confirmed by the user at registration, including for an account created through Google sign-in, which requires age confirmation immediately after the first sign-in before the account can publish, message or transact.
1.7. The Platform is currently free to use. Paid listings, dealer subscriptions, Boost, Premium, Top, commissions and other paid products are not currently active — see Section 13.
1.8. MIGRASH may change interface elements, technical limits and safety controls. Material changes that affect user rights or obligations will be announced with reasonable advance notice where practicable, except where a shorter period is required by law, security or urgent operational reasons. Users may stop using the affected service.
2. Marketplace and Vehicle Listings
2.1. The seller is responsible for the legality and accuracy of the listing and the underlying vehicle or item, including make, model, year, mileage, trim, specifications, condition, history, accident information, price, photographs, ownership-related statements, availability and sale status.
2.2. A user may publish a listing only when they have the right or lawful authority to offer the vehicle or item, or have clearly disclosed the relevant representative capacity.
2.3. Listings must not be knowingly false, materially misleading, fraudulent, duplicated for abuse, or designed to obtain money, credentials or personal data through deception.
2.4. Photographs must depict the actual vehicle or item unless clearly marked as illustrative. Users must have the right to upload each image, and should review photos before publishing for unintended disclosure of faces, documents, addresses, phone numbers, registration plates or other personal information.
2.5. A VIN and ownership documents are not mandatory for the basic listing flow unless a specific feature requires them. Their absence does not constitute verification of ownership or legal status.
2.6. MIGRASH may perform automated or manual checks, including image, content, identity, fraud or abuse checks. No such check is a complete legal, technical, insurance or expert inspection unless a separate service expressly says so.
2.7. A Listing Transparency score, seller-reported condition, seller rating, verification badge, listing status or other indicator is informational and is not a warranty of roadworthiness, legal title, accident history, market value, safety or transaction outcome. The Listing Transparency score reflects only how completely the seller filled in the listing — it is not an inspection or assessment of the vehicle's mechanical condition.
2.8. Buyers should independently verify material facts before paying or signing, including physical inspection, documentation, the seller’s identity, vehicle identification, diagnostics and any professional inspection appropriate to the transaction.
2.9. MIGRASH may prevent publication, reduce visibility, flag, pause or remove a listing where there is a credible indication of illegality, fraud, safety risk, rights infringement, duplicate abuse or a breach of these Terms.
3. Professional Sellers, Dealers and Used-Vehicle Disclosure
3.1. A seller acting as a business, dealer or professional vehicle seller must accurately identify that status where the Platform asks for it, and must comply with all obligations that apply to the seller’s own commercial activity.
3.2. The term “professional seller” in these Terms does not itself determine statutory status. Where a seller qualifies as an “עוסק ברכב” (vehicle dealer) or another regulated seller under Israeli law, the seller must comply with the duties attached to that legal status.
3.3. Where the Used Vehicle Sale (Eligibility for Information and Disclosure) Law, 5768–2008 applies, the seller remains responsible for the statutory disclosure duties, including the written disclosure information and any contract or form required by law. MIGRASH does not replace the seller’s statutory disclosure document or sale contract.
3.4. The Platform may request a seller to complete structured fields or upload supporting disclosure materials, or may provide a structured digital disclosure flow before a listing is published or marked as a business sale. This is an administrative tool only — it does not transfer the seller’s statutory responsibility to MIGRASH and is not an independent inspection or legal certification.
3.5. Professional sellers must not use MIGRASH to conceal their commercial status, misrepresent ownership, disguise dealer inventory as a private sale, or publish materially incomplete information intended to influence a consumer’s decision.
3.6. Business-to-consumer transactions remain subject to the mandatory consumer-protection rules that apply to the seller and the transaction. These Terms do not waive or reduce mandatory consumer rights.
3.7. Before introducing services that materially intervene in a vehicle transaction, collect transaction commissions or act on behalf of a seller, MIGRASH will assess whether additional licensing or regulatory obligations apply.
4. Community, Reviews, User Content and Chat
4.1. These rules apply to listings, posts, profiles, Garage entries, comments, reviews, messages and other user-generated content.
• Fraud, impersonation, fabricated evidence, fake identities and attempts to obtain money or credentials by deception are prohibited.
• Threats, stalking, targeted harassment, discriminatory abuse and unlawful or harmful content are prohibited.
• Spam, mass unsolicited messages, manipulation of likes, follows or reviews, and circumvention of blocks are prohibited.
• Users may not knowingly publish false statements presented as facts about another person, seller, vehicle or business. Opinions and criticism must be expressed without prohibited personal abuse or fabricated claims.
• Reviews should be based on genuine interaction. Paid, coordinated or fabricated reviews may be removed and may result in account action.
• Users must not publish another person’s documents, private contact details, precise location or other private data without a lawful basis or permission where required.
4.2. A user may block another user and report a listing, profile, post, message, review or conversation through the reporting tools available throughout the Platform. Reports should contain enough detail for MIGRASH to locate and assess the relevant content.
4.3. Private chats are treated as user communications within the Platform. MIGRASH stores messages, metadata and security events as described in the Privacy Policy and the Retention Schedule (Annex A). Ordinary staff have no visibility into chat content through the admin interface. A staff member may read a specific conversation only after a report has been filed that names that conversation, and only for as long as needed to review that report — every such access is logged, recording who accessed it, when, and which report justified it.
4.4. The Platform is not an end-to-end encrypted messaging service unless a particular feature expressly states otherwise. Users should avoid sending passwords, payment-card numbers, identity documents or other highly sensitive information in ordinary chat.
4.5. User-generated content may remain visible to others or be preserved in limited form after account deletion where necessary for legal, security, dispute or integrity purposes, subject to the Retention Schedule and applicable law.
4.6. Users must not use the Platform to knowingly publish false factual allegations about another person, seller or business in a way that may unlawfully harm reputation. MIGRASH may review reported reputation-related content in good faith and may remove, restrict or retain it according to the evidence, applicable law and the moderation process.
4.7. Promotional email, SMS or other direct marketing messages will be sent only where the required consent or other lawful basis exists, with an effective unsubscribe method. Transactional and security notices may be sent when necessary to operate the account or comply with law.
5. Reporting, Takedown, Appeals and Moderation
5.1. MIGRASH operates a notice-and-review process for suspected illegal, fraudulent, infringing or seriously abusive content. The existence of a report does not automatically establish the allegation or require automatic removal.
5.2. Target handling times: urgent reports involving an immediate safety threat, credible criminal conduct or clearly unlawful material are prioritized as soon as reasonably practicable; ordinary reports are targeted for review within 5 business days; receipt of a report may be acknowledged within 2 business days where contact details are available.
5.3. Depending on the circumstances, MIGRASH may leave content online, add a restriction, reduce visibility, remove the content, suspend an account, or request additional information. Measures may be temporary while the review is open.
5.4. When content is removed or an account is restricted for a rule-based reason, MIGRASH will provide a brief explanation of the relevant category or reason where legally and operationally appropriate. Security-sensitive details may be withheld where disclosure would create additional risk.
5.5. A user whose content or account is restricted may appeal, normally within 14 calendar days of notice, through the Help & Support ticket system, linked to the report and decision being appealed. The appeal should identify the action and the reason the user believes it was incorrect. Target review time is 7 business days for ordinary appeals.
5.6. MIGRASH preserves evidence relating to an incident, complaint, appeal or legal request only for the period and purposes described in the Retention Schedule (Annex A) or as required by law.
5.7. Moderation procedures are intended to support prompt, good-faith handling of complaints and lawful content, but they do not create absolute immunity or a guarantee against liability, and do not waive rights available under mandatory law.
5.8. Where a report concerns alleged defamation, privacy infringement, copyright or other rights-based harm, MIGRASH may request the complainant to identify the specific statement or content, the affected right and the factual basis for the complaint. A report does not by itself establish liability.
5.9. Where a user has an appeal route, the appeal is reviewed separately from the original decision where reasonably practicable. MIGRASH may maintain temporary restrictions during review where necessary for safety, fraud prevention or legal compliance. A history of past reports against the same user or content is used only as internal context for a moderator’s review — never to automatically block, ban or restrict an account, since a report is an allegation, not a proven violation.
6. Privacy Policy
6.1. MIGRASH processes personal information to provide the Platform, manage accounts, publish listings, facilitate user-to-user communication, maintain safety, prevent fraud and abuse, provide support, operate analytics where enabled, and comply with law. The purpose and legal basis are determined for each processing activity under applicable Israeli law.
6.2. “Personal information” is understood broadly in accordance with applicable Israeli privacy law and may include information relating to an identified or identifiable individual. The categories MIGRASH processes are:
• Account — name, email, phone where provided, account identifiers and authentication data, used for account creation, login, security and support.
• Profile / social — avatar, username, bio, city/region, interests, favorite brands/models, links, followers/following and visibility settings.
• Listings / Garage — vehicle or part information, price, photos, descriptions, saved vehicles and listing status.
• Interactions — chats, reviews, comments, likes, follows, saves, reports, blocks, support tickets and appeals.
• Technical / security — IP address (stored as a one-way cryptographic hash, not in plaintext, for rate-limiting and abuse-prevention purposes), browser/device information, sessions, timestamps, logs, error data and abuse indicators. The Platform does not collect precise location through the browser geolocation API — only the city/region a user optionally adds to their profile.
• Smart Search — the text of your search and related interaction data, used to interpret queries and apply available structured filters. No third-party AI provider is used for this function.
• Payment (future only) — if paid services are later enabled, payment information will be handled by a third-party payment processor; MIGRASH will not intentionally store full card credentials.
6.3. Typical processing purposes and their legal basis include: providing a requested account or service feature; obtaining consent where consent is the appropriate basis (for example, optional analytics or marketing); complying with a legal obligation; preventing fraud and securing the Platform; and establishing, exercising or defending legal claims. A consent checkbox is not used as a substitute for every other lawful basis.
6.4. Public content. When a user makes a profile, listing, review, post, Garage entry or other material public, that material may be viewed and copied by other users and is processed as necessary to display the Platform. Privacy settings apply only to the extent actually offered by the relevant feature.
6.5. Service providers. Current production services include Vercel for hosting and deployment, Neon for the database, Vercel Blob for file and photo storage, Resend for email delivery, Google for account sign-in, Google Analytics for website analytics, and Google Ads for conversion tracking of the Platform’s own advertising. No third-party AI provider is used.
6.6. Cross-border processing. Where personal information is processed by a provider outside Israel, MIGRASH applies the contractual and organizational safeguards required for such transfers under applicable Israeli law.
6.7. Disclosure to third parties may occur when necessary to provide a requested service, operate security and support, comply with a lawful order or statutory obligation, prevent fraud or abuse, or protect the rights of MIGRASH, users or third parties, within the limits of applicable law.
6.8. MIGRASH does not sell personal information to third parties for their own direct marketing purposes.
6.9. User rights may include access to and correction of personal information and, where provided by law, deletion or other restriction. Requests are handled through the process in Annex B. Where a request cannot legally be fulfilled in full, MIGRASH will explain the applicable limitation where permitted.
6.10. MIGRASH assesses on an ongoing basis whether its data-processing activities require database registration, a privacy officer (DPO) or other governance duties under applicable Israeli privacy law, based on its actual scale, data categories and processing activities.
6.11. MIGRASH applies technical and organizational measures appropriate to the Platform, including access control, authentication protections, rate limiting, security logging, file validation and incident-response controls. No online system can be guaranteed to be absolutely secure.
6.12. Passwords are never stored in plain text. Authentication credentials are hashed using industry-standard methods designed to prevent recovery of the original password from stored data.
6.13. Where required by applicable law, MIGRASH provides users with clear notice at the point of collection about the identity and contact details of the operator, the categories of information collected, the purposes of processing, relevant recipients or service providers, retention principles, rights, and the channels for privacy requests.
6.14. Personal information may be received directly from the user, generated through use of the Platform, or received from service providers, security systems or other lawful sources where applicable.
6.15. MIGRASH does not request highly sensitive personal information through ordinary listing or chat flows. Users should not upload identity documents, bank details or similarly sensitive data to public content areas.
6.16. Identity verification may be required before fulfilling a privacy request where disclosure or correction could expose another person’s information or create a security risk. A lawful request is handled within the period required by applicable law; the procedure published in Annex B is operational guidance and does not shorten or extend statutory rights.
8. User Content and Intellectual Property
8.1. Users retain their rights in content they lawfully own. Nothing in these Terms transfers ownership of user content to MIGRASH.
8.2. By uploading or publishing content, the user grants MIGRASH a non-exclusive, worldwide, royalty-free license, for as long as necessary, to host, store, technically process, reproduce, display and distribute that content through the Platform and its normal sharing features. Separate consent is required for unrelated advertising use — see 8.8.
8.3. The user represents that they have the rights required to publish the content and that it does not unlawfully infringe another person’s copyright, trademark, privacy, publicity or other rights.
8.4. MIGRASH and its licensors retain rights in the MIGRASH name, logos, visual identity, software, code, interface, database structure, texts, original graphics and other Platform materials, subject to the rights of third parties.
8.5. Complaints about copyright, trademark, privacy or image-right violations are handled through the notice procedure in Annex C. MIGRASH may request additional evidence and may restrict the disputed content while it investigates.
8.6. Before publishing photographs, videos, documents or other third-party material, you must confirm that you own the necessary rights or have obtained the permissions required for publication. This confirmation is a mandatory checkbox on every upload of a listing, part, Garage or profile photo — MIGRASH records your user ID, the content or listing ID, the timestamp and the applicable Terms/UGC-policy version each time you confirm it.
8.7. The license in 8.2 covers ordinary operation of MIGRASH: hosting, storage, backup, resizing, compression, thumbnails, CDN delivery, search, listing display, social/feed display where you have chosen to make content public, and normal sharing functions. It does not automatically create an unrestricted advertising license.
8.8. If MIGRASH wishes to use your photographs, posts or other content in external advertising, paid campaigns, press materials or other promotional activity beyond the ordinary operation of the Platform, MIGRASH will seek your separate permission where required by law.
8.9. A photograph being publicly available elsewhere on the internet does not by itself give you permission to upload or reproduce it on MIGRASH.
8.10. The person shown in a photograph is not necessarily the copyright owner. You must have the required rights from the photographer or rightsholder and, where required, the necessary permission concerning any identifiable person shown, their privacy and image rights.
8.11. Do not publish identifiable children, identity documents, medical information, financial information or other sensitive personal material in public areas of the Platform unless there is a lawful and documented reason.
8.12. Vehicle photographs may show a license plate or other identifying details. MIGRASH does not automatically mask or blur these — please review your photos before publishing and avoid uploading images that expose identifying details you do not want to make public.
8.13. MIGRASH automatically removes EXIF metadata, including embedded GPS location data, from photographs uploaded to the Platform, as part of the standard image-processing pipeline applied to every upload.
8.14. Ordinary technical transformations such as resizing, cropping, compression, thumbnail generation, format conversion and caching are part of operating the Platform and do not transfer ownership of your content.
8.15. A rights holder may submit a copyright, trademark, privacy, image-right, personal-information or other rights-based complaint through the report tools available on listings, parts, profiles, My Cars entries and conversations, identifying the content, the claimed right and the factual basis, and providing supporting evidence where reasonably available. Rights-based complaints require a good-faith confirmation from the complainant before they are submitted.
8.16. Where appropriate, the uploader has an opportunity to provide evidence of ownership, authorization, license or another lawful basis before a final decision. Temporary restrictions may remain in place while a dispute is reviewed.
8.17. MIGRASH maintains a documented, proportionate process for tracking repeated complaints against the same account. This history is used as context for a moderator’s decision, never to automatically suspend, ban or restrict an account — a report is an allegation, and every case is reviewed individually.
8.18. For a rights-based complaint, MIGRASH preserves the relevant content ID, uploader ID, timestamps, the notice itself, supporting evidence, the moderation decision and any appeal, for the retention period set out in Annex A. Removing content does not automatically delete this evidence record.
8.19. A complaint does not automatically establish infringement or liability. MIGRASH may request evidence and take proportionate interim measures while a complaint is reviewed.
8.20. To the maximum extent permitted by law, the uploader remains responsible for claims arising from content uploaded in breach of the representations in 8.3.
9. Smart Search and Automated Assistance Disclosure
9.1. MIGRASH provides an automated Smart Search function that interprets a user’s search wording and maps it to available structured filters and listing data. Smart Search does not use a third-party generative AI model and is not a full AI system — it is internal structured-filter matching.
9.2. Smart Search results may be incomplete, inaccurate, or based on incomplete or ambiguous input. The feature is a search-assistance mechanism, not legal advice, a mechanical diagnosis, an expert inspection, an ownership determination, or a guarantee of price, condition, compatibility or transaction outcome.
9.3. Smart Search does not independently verify facts about a vehicle, seller, ownership, history, condition or compatibility. Where the structured data does not support a result, the interface avoids creating a false impression of certainty and directs the user to the underlying listing data.
9.4. Seller-provided listing data shown on the actual listing page takes priority over any search interpretation. Users remain responsible for checking material facts before a transaction.
9.5. Smart Search may process the text of a user’s query, selected vehicle context and related interaction data as necessary to return search results. Where such information is personal information, it is handled under the Privacy Policy.
9.6. Automated search functionality does not remove the application of consumer-protection and anti-deception rules to representations actually made by the Platform. MIGRASH does not describe Smart Search as a verified AI system or as a source of independently verified vehicle facts.
9.7. No external AI provider is currently used for Smart Search. If MIGRASH later introduces a third-party AI model or another external automated intelligence service, the relevant provider, data flow, processing purpose and cross-border transfer implications will be reviewed and disclosed before activation where required.
9.8. A Smart Search explanation, filter interpretation or automated suggestion does not convert user-supplied listing information into verified information and is not an inspection, appraisal or legal finding.
10. MIGRASH PARTS and Compatibility
10.1. MIGRASH PARTS is a separate product mode for vehicle parts, tuning, wheels, accessories, body components and universal products, sharing the same account, safety, moderation, chat and seller infrastructure as the vehicle marketplace.
10.2. A vehicle selected for a Parts search is a temporary search context and does not modify your permanent Garage collection unless you explicitly choose to save it.
10.3. Compatibility may be shown as “Exact match”, “Possible match”, “Not compatible” or “Universal”. The displayed status is based on available structured data or another identifiable source and is not a guarantee of physical installation.
10.4. Where a compatibility status is displayed, the interface identifies its source — such as seller-supplied data, catalog/vehicle-reference data or algorithmic inference. Algorithmic inference is not represented as a manufacturer certification.
10.5. Sellers remain responsible for the accuracy of part numbers, brands, dimensions, specifications, condition and claimed compatibility. Buyers should independently confirm OEM/part numbers, measurements, model year, generation, engine, transmission and other fitment variables before purchase or installation.
10.6. “Universal” means the item is offered without a required single-vehicle association — it does not mean the item is compatible with every vehicle.
10.7. When an “Exact match” or equivalent high-confidence compatibility label is used, the Platform makes the relevant fitment source or data context discoverable where technically available. The label remains informational unless a separate written service expressly provides a verified fitment warranty.
11. Profiles, Garage and Social Functions
11.1. Profiles may include usernames, avatars, biographies, region, interests, favorite brands/models, links, followers/following, reviews, listings, Garage vehicles and other activity, depending on the features enabled for the account.
11.2. Users control visibility only through the privacy settings actually offered. Public content may be seen by other users and, where the Platform exposes it publicly, by search engines.
11.3. A follow, rating, review, badge, follower count or other social signal does not guarantee the identity, honesty, financial position, technical competence, vehicle condition or transaction performance of any user.
11.4. MIGRASH may restrict visibility or interaction tools when necessary for privacy, safety, moderation or legal compliance, subject to the appeal process in Section 5 where applicable.
12. Security, Abuse Prevention and Data Incidents
12.1. MIGRASH uses technical and organizational safeguards appropriate to an online platform, including access controls, authentication protections, secure session handling, anti-abuse controls, monitoring and security logs.
12.2. A suspected account compromise or security incident may lead to temporary access restrictions, password or session resets, isolation of functions or other emergency measures. Users may be asked to re-authenticate or provide additional verification.
12.3. MIGRASH maintains an internal incident-response procedure. When a security incident occurs, MIGRASH assesses the incident, contains it, investigates the scope, documents material findings and makes the notifications required by applicable law.
12.4. Where applicable law requires notification to the competent privacy authority regarding a severe information-security incident, MIGRASH makes the required report without unnecessary delay. Affected users are informed where the law requires such notice or where MIGRASH determines that notice is appropriate and permitted.
12.5. Security-related records may be retained for investigation, legal compliance and prevention of recurrence according to Annex A. Retention is not unlimited by default.
12.6. Internal incident response includes, as appropriate: identifying the affected systems and data, containment, evidence preservation, access review, remediation, vendor coordination, risk assessment and documentation of notification decisions. Not every incident requires user notification; notification follows applicable law and the facts of the incident.
13. Paid Services and Future Monetization
13.1. No paid services are currently active unless the Site explicitly displays a live paid checkout. Promotion, Boost, Premium, Top, dealer subscriptions and commissions are not currently chargeable products.
13.2. Before activating any paid product, MIGRASH will publish the applicable commercial terms and configure the checkout to display the price, tax treatment where applicable, billing period, renewal terms, cancellation method, refund rules and legally required disclosures.
13.3. Where a payment processor is used, payment credentials are processed by that processor under its own security and privacy controls. MIGRASH minimizes access to payment credentials and does not intentionally retain full card data when a hosted or tokenized flow is used.
13.4. Future subscriptions and distance transactions will operate subject to the mandatory consumer-protection requirements applicable to the particular product, including rules governing disclosure, cancellation, continuing transactions, refunds and invoicing.
13.5. Enabling a payment feature in the technical system alone does not constitute an offer to purchase. MIGRASH will activate paid services only after the relevant product, legal and tax controls are in place.
13.6. No recurring charge is activated without the corresponding user-facing subscription disclosure and cancellation mechanism required for the product.
13.7. Before launching paid services, MIGRASH will confirm the identity and contractual role of the payment processor, invoice/tax treatment, customer support route, refund process and any continuing-transaction requirements applicable to the product.
14. Warranty Disclaimer and Liability
14.1. The Platform is provided on an “as available” basis to the extent permitted by law. MIGRASH seeks to maintain reliable service but does not guarantee uninterrupted operation, error-free availability, or that every listing, message or user can be reached at every moment.
14.2. Subject to mandatory law, MIGRASH is not responsible for actions or omissions of sellers, buyers, dealers or other third parties, for the accuracy of user listings, for vehicle or part condition, for private agreements, or for losses arising solely from a third party’s conduct.
14.3. Any automatic score, rating, badge, Smart Search result, compatibility status or other signal is informational unless a separate paid or regulated service expressly creates a different contractual obligation.
14.4. Nothing in these Terms excludes or limits rights, remedies or liabilities that cannot lawfully be excluded or limited under mandatory Israeli law.
15. Account Deletion, Retention and Suspension
15.1. Users may request deletion of their account through the account page or through the privacy contact in Annex B.
15.2. On verified deletion, MIGRASH anonymizes the account — removing your name, contact details and password — rather than deleting the row outright, because other users’ chats and reviews involving you are entitled to remain intact for them. Personal information that no longer has a lawful retention purpose is deleted or anonymized. Certain records may remain for a defined period where needed for security, fraud prevention, legal obligations, dispute resolution or system backups.
15.3. The standard retention periods are described in Annex A. A specific legal obligation, court order or active dispute may require a longer period for the affected record only.
15.4. If account deletion occurs while a moderation review, fraud investigation or legal process is open, the account is closed while the minimum relevant evidence is retained under Annex A. This does not authorize indefinite retention.
15.5. MIGRASH may suspend or terminate an account for material rule violations, fraud, a credible security risk, unlawful activity, repeated abuse or legal requirements. Where appropriate, the user is informed of the reason and may appeal under Section 5.
15.6. Backup copies are rotated and are not used as an alternative active repository. Backup retention is limited to the schedule in Annex A unless a specific incident requires preservation.
16. Accessibility Statement
16.1. MIGRASH is committed to providing an accessible web service and to addressing accessibility barriers in accordance with applicable Israeli requirements, using Israeli Standard SI 5568 as a principal reference for web-content accessibility.
16.2. The current accessibility contact channel is migrashonline@gmail.com. A named accessibility coordinator has not yet been appointed.
16.3. MIGRASH does not claim that the entire Site has achieved a specific compliance level unless that claim reflects an actual completed technical accessibility review.
16.4. Accessibility requests may be directed to migrashonline@gmail.com. Reports should describe the page or function and, where possible, the device, browser or assistive technology used. MIGRASH will consider reasonable and technically feasible remedies where a barrier is identified.
16.5. This statement is kept consistent with the actual Site and will identify known limitations and available alternatives where applicable.
17. Changes, Governing Law and Contacts
17.1. These Terms and the related legal policies are governed by the laws of the State of Israel, subject to mandatory consumer, privacy, accessibility and other non-waivable rights.
17.2. Disputes are subject to the competent Israeli courts and the jurisdictional rules established by law. Nothing here is intended to deprive a consumer of a mandatory right or statutory remedy.
17.3. Material changes affecting user rights or obligations will be announced with reasonable advance notice through the Site, an account notice or another appropriate channel where practicable. Changes required urgently for security or law may take effect earlier, with notice given as soon as feasible.
17.4. Continued use after the effective date of an updated policy constitutes acceptance only to the extent such acceptance is legally effective. If you do not accept a material change, you may stop using the affected service or close your account, subject to already-accrued obligations.
17.5. Current official contact channel: migrashonline@gmail.com. Support: available through the Help & Support page. For operational separation while only one project mailbox exists, MIGRASH may use subject prefixes such as LEGAL, PRIVACY, REPORT, APPEAL, IP and ACCESSIBILITY.
17.6. The Hebrew version of these policies is the controlling version in case of a conflict between the Hebrew, English, Russian and Arabic translations, to the extent permitted by law.
17.7. MIGRASH ONLINE is currently operated by Oleg Yampolsky as an individual operator. No company has yet been registered for the project; incorporation is planned. The public legal pages will be updated with the operator’s registered identity and address once the business is registered.
Annexes
Annex A. Data Retention Schedule
Retention is purpose-limited. The periods below are the Platform’s operational targets. A specific statutory, tax, accounting, court or litigation-preservation requirement overrides the standard target for the affected record only.
• Active account data — for the life of the account; after verified deletion, erased or anonymized within 30 days unless a lawful exception applies.
• Listings and listing history — while active or required for the service; after deletion or closure, related personal identifiers are retained for up to 24 months for fraud, dispute and integrity purposes, then anonymized or deleted.
• Private chat content — during the active relationship and up to 24 months after the last message or verified account closure, unless a legal or security hold applies.
• Reviews, comments and other public user content — while published; after account closure, only the minimum needed for service integrity, moderation or legal defense is retained, targeted at up to 24 months, with anonymization where practical.
• Reports, moderation cases and appeals — up to 36 months after closure of the case, unless a legal or security hold applies.
• Security and access logs — up to 24 months, with longer preservation only for a defined incident, legal obligation or active dispute.
• Support tickets — up to 24 months after closure, unless a legal or dispute-related reason requires longer retention.
• Consent records — for as long as reasonably necessary to demonstrate the consent decision and compliance, targeted at 36 months after withdrawal or the last relevant interaction, unless a longer legal period applies.
• Backups — rolling retention targeted at 90 days. Deleted data may persist in encrypted backup snapshots until the normal rotation cycle completes.
• Accounting, tax and paid-service records — for the period required by applicable tax, accounting or other mandatory law. No paid-service records currently exist, since no paid checkout is active.
Annex B. Privacy Rights Request Procedure
1. Submit the request to migrashonline@gmail.com or through the privacy-request option on the Site.
2. State the requested right (access, correction, deletion or another legally available request), your account email or username, and enough information to locate the relevant data.

Annex D. Professional Seller / Dealer Disclosure
D.1. A business seller must identify itself accurately as a professional/dealer seller where required by MIGRASH.
D.2. For a used-vehicle transaction to which the Israeli Used Vehicle Sale (Information and Disclosure) Law, 5768-2008 applies, the seller is responsible for fulfilling all statutory disclosure obligations and providing the required information to the buyer. MIGRASH’s listing form does not replace the statutory disclosure form.
D.3. Where the Platform offers a digital disclosure form, the form is a collection and presentation tool. The seller remains responsible for the completeness and truthfulness of the information entered, including known damage/injury history, mileage and other information required by applicable law.
D.4. A professional seller must not use a “private seller” presentation, hidden dealer identity, false “owner” statements or other interface choices to materially mislead consumers about the seller’s status.
D.5. If the business model later adds transaction facilitation, escrow, commissions, financing referrals or other intervention in the sale, separate legal and regulatory review is required before activation.
